DoD PURSUES “REGULATORY/DFARS TRANSFORMATION” INITIATIVE.
Last month’s Update stated that “DoD announced that it has initiated a ‘Defense Task Force for Regulation Transformation’ with a focus on the transformation of FAR and DFARS.  The reported ‘aim (is) to shorten DoD rule-making processes by 50% and to eliminate all unnecessary rules’ with three phases in the released DFARS plan.” This Special Regulatory Update is being issued in order to provide recent information on this initiative with timely reference material.

What is “DFARS Transformation?” Principal Deputy Under Secretary of Defense, Michael Wynne on February 19, 2003, issued a Memorandum stating that this initiative was commenced in “an effort to dramatically change the purpose and content of the DFARS and the processes we use to generate, communicate and maintain the regulation.” A task force has been staffed under the leadership of Deputy Director Ron Poussard who reports to DoD Director of Defense Procurement and Acquisition Policy, Ms. Deidre Lee.  As stated by Mr. Wynne in his Memorandum, the task force is

“to identify value-based improvements and reductions to the DFARS policies, procedures, and processes.  The task force has 75 days to develop high-value regulatory and legislative proposals (with Federal Register publication).  My mark is to reduce the regulatory burden by 40 to 60 percent and cut the regulation process in half.” 

The Acquisition Executives and Directors of Defense Agencies were requested in the Memorandum to establish a concurrent effort in their organizations.    

“Proposals” are solicited from within DoD as well as “the public” with a due date of March 28, 2003. Currently available information at the task force website <http://www.acq.osd.mil/dp/dars/transf.htm> includes background on the initiative, FAQs, format for submitting a “DFARS Improvement Proposal,” previously submitted Proposals, staffing/structure with “30 participants,” etc. Briefing charts are also available.

COMMENT: This is an excellent opportunity for the Government and industry to jointly streamline the DFARS and improve the acquisition process including all Parts/ Appendices of the DFARS!
